On August 24, 1954, the petitioner, Wallace Havely, filed a claim against the estate of Bernard Ludwig Lloyd, deceased, in the probate court of Labette County, in the amount of $20,000 for damages sustained by him on December 16, 1953, which were alleged to have been caused by the negligence of the decedent, Bernard Ludwig Lloyd.
