This matter was submitted to the Court herein on a stipulation of facts filed herein on the 16th day of March, 1954. Thereafter an offer of proof was made by the plaintiff and the offer of proof was admitted over the objection of the government, and the matter was taken under advisement. This court by memorandum opinion, following the opinion in the case of Jones v. Taunah, decided by the Tenth Circuit, 186 F.2d 445
