This was an appeal from the order of the trial court denying appellant's petition for allowance of demand against the estate of Grace Timkin, deceased.

For convenience we will hereafter refer to Thomas H. Crotinger as Thomas, Grace Timken as Grace, Mary Louise Crotinger as Mary, Douglas J. Kise as Kise, and O.A. Wilson as the attorney.
