This is a child custody case. Appellant, Mrs. Mary Roberts, was formerly the wife of appellee, Lon W. Jolly. Allen Wayne Jolly, a son, twelve years of age at the time of the trial, was born of that union. In a suit tried in the 41st District Court, No. 73,419, in which appellant was plaintiff and appellee defendant, judgment was rendered on August 12, 1952.
