We will refer to the litigants in the position they occupied in the Chancery Court. Both parties to the cause, which was heard on demurrer, have appealed and assigned error. The suit was filed under the Declaratory Judgment Act (Williams' Code, Section 8835 et seq.) by and through the Commissioner of Education for the use and benefit of the City of Nashville, its Board of Education, etc., against Davidson County, its Trustee and Davidson County Board...
