This action arose by complaint in mandamus to compel the president of city council to issue a writ of special election. Plaintiff then moved for summary judgment under Pa. R. C. P. 1098 and a hearing was had thereon. Defendant filed preliminary objections in the nature of a demurrer thus making the matter ripe for adjudication.
