Defendant, Donald L. Emery, was apprehended while operating his motor vehicle in the Borough of Milton, in this county, and charged with a violation of section 1002(a) of The Vehicle Code of May 1, 1929, P. L. 905, as amended, 75 PS §501. He waived a hearing on this summary offense before the justice of the peace. When the case was called in quarter sessions court, a motion was made to quash the information for lack of jurisdiction...
