OPINION BY MR. JUSTICE JONES, May 25, 1955:

The plaintiff sued to recover damages for personal injuries sustained in a fall from the roof of the defendant's apartment house. The jury returned a money verdict for the plaintiff. Upon the defendant's motion, the court en banc entered judgment n.o.v. for the defendant on the grounds that the plaintiff failed to establish causative negligence on the part of the defendant and that he was guilty of contributory negligence...
