Appellant, James Eugene Smith, was tried and convicted of the crime of murder and sentenced to death at the June, 1953, Term of the Court of General Sessions for Abbeville County. A motion for a new trial was duly made and granted by order of the Honorable Steve C. Griffith, dated July 31, 1953.
