Gertrude Grant was convicted in the Circuit Court of Jackson County, Missouri, on a charge of burglary in the second degree and sentenced to imprisonment in the State Penitentiary for a term of two years. She appealed.

The State filed a motion to dismiss the appeal stating as reasons therefor that the defendant did not timely file a notice of appeal and failed to file a transcript of the record within proper time. We shall consider the motion...
