In this action under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, 2671-2678, 2680, plaintiff claims that the fall of plaster from the ceilings of his house on Turner's Creek, in Kent County, on the Eastern Shore of Maryland, during the years 1952 and 1953, was caused by the firing of cannon during testing operations at the Aberdeen Proving Ground, some 8 miles away across the upper reaches of the Chesapeake Bay.
