This is an error proceeding from the district court for Pawnee County. Plaintiff in error Lawrence Gates, whom we shall hereinafter refer to as defendant, was therein convicted of auto theft and, after his motion for a new trial had been overruled, sentenced to serve 6 years in the State Penitentiary.

Defendant was charged with having, on February 19, 1954, stolen a 1951 black Plymouth sedan, motor No. P-2369642, the property of Mollie Mosteller...
