This is a suit under the Federal Employers' Liability Act. Defendant appeals from a judgment on a verdict for $50,000. Plaintiff was employed as a brakeman and about 2:00 a.m. on December 28, 1949, he was proceeding in the course of his work from the south to the north side of a track in defendant's yard at Toledo, Ohio.
