This action is based upon the plaintiffs' claim against the defendant arising from an automobile accident, wherein their mother had been injured. Plaintiffs' mother was in a car driven by her husband, Louis Abrams. James Meredith, defendant and third-party plaintiff, drove the other car involved in the collision.
