1. The writ of error must be dismissed as to the exception to the grant of the new trial on motion by the defendant after the first trial, for the reason that the judgment granting a new trial was such a judgment as required direct exception within fifteen days from the judgment granting the new trial. Such a judgment is not an interlocutory judgment as to the second trial.
