Defendant appeals from a judgment based upon a verdict awarding plaintiff damages under a contract of employment.

The facts are these: plaintiff, E.L. Lyall, was employed by defendant, J.F. Bianconi, to work in the latter's business of constructing irrigation ditches in the Yuma, Arizona area.
