PER CURIAM.

The defendant was indicted by the Grand Jury of Carroll County and charged with the crime of embezzlement by agent under the provisions of section 710.5, 1950 Code of Iowa, I.C.A. Upon trial the defendant was found guilty. His motion in arrest of judgment, as well as a motion for new trial, was over-ruled. Thereafter he was sentenced to a term of 5 years in the State Penitentiary at Ft. Madison. From the judgment and sentence imposed he has appealed.<...
