Plaintiff in error, LeRoy Samuels, defendant below, was charged by information, in the Court of Common Pleas in Tulsa County, Oklahoma, for the offense of having operated a motor vehicle while under the influence of intoxicating liquor. The offense was allegedly committed, in Tulsa, on the 5th day of November, 1954. Defendant was tried by a jury, convicted, and his punishment was assessed at a fine of $37.50, and costs; judgment and sentence was entered...
