Jerry Boyd, plaintiff in error, hereinafter referred to as defendant, was charged by information filed in the district court of Oklahoma County with the crime of "Possession of marihuana, after former conviction of a felony". A jury being waived, the defendant was tried before the court, who found him guilty, and on May 26, 1954 sentenced accused to a term of six years in the State Penitentiary at McAlester...
