This is an appeal from an order dismissing an action instituted in forma pauperis. The action was one to recover a lot in Chevy Chase, Maryland, with rents and profits from April 27, 1940. Plaintiff had been allowed to commence and prosecute the suit in forma pauperis under 28 U.S.C. § 1915 which provides, however, that the court "may dismiss the case * * * if satisfied that the action is frivolous or malicious."
