The plaintiff in error, Rubin Shetsky, hereinafter referred to as defendant, Frank James Ellsworth and Charles Claire Taylor, were jointly charged in the district court of Tulsa County with the crime of second degree burglary by in the nighttime breaking and entering a certain store in Tulsa, and taking, stealing and carrying away certain personal property.
