This proceeding was instituted when plaintiff and appellant, J. Fred Howard (hereinafter referred to as "appellant") filed in the Superior Court of Los Angeles County a "complaint for declaratory relief and on contract." In said complaint, June Paschall Howard and Bank of America National Trust and Savings Association, as guardian of the estate of said June Paschall Howard, were named as defendants.
