RIDGE, District Judge.

Defendant first entered a plea of guilty to violation of Section 1702, Title 18 U.S. C.A. Thereafter, by leave of court, without objection on the part of the Government, defendant withdrew such plea and entered a plea of "not guilty." Leave of court was so granted because of an apparent conflict in the case law with respect to the proper construction to be given to Section 1702, Title 18 U.S.C.A., under which the Information herein is laid....
