The defendant appearing specially moves for an order "vacating and setting aside the interlocutory decree entered herein on the 17th day of June, 1955 and dismissing the complaint upon the ground that the Court did not acquire jurisdiction of the person of the defendant by reason of his being under age, and upon the ground that plaintiff has failed to comply with the law pertaining to the entry of judgments against those in Military Service....
