HOLLINGSWORTH, Judge.

On the 19th day of August, 1953, in Chariton County, Missouri, defendant fired three shots from a shotgun into the body of Francis Johnson, seriously but not fatally wounding him. Upon trial by jury in the circuit court, defendant was found guilty of felonious assault without malice aforethought and his punishment was fixed at imprisonment in the State Penitentiary for a term of two years. He has appealed from the judgment and sentence imposed...
