Plaintiff and appellant city of Dearborn, a Michigan municipal corporation, on February 16, 1955, filed its bill of complaint seeking a declaration of rights and an injunction restraining defendant and appellee from acquiring property in the city of Dearborn for a turnpike highway. On March 8, 1955, the trial court granted the petition to intervene of the Michigan Free Highways Protective Association.
