Defendant was indicted under section 854 of The Penal Code of June 24, 1939, P. L. 872, 18 PS §4854, which reads in part as follows:

"Whoever, with intent to defraud, makes, . . . any check . . . upon any bank . . . knowing, at the time of such making, . . . that the maker . . . has not sufficient funds in, or credit with such bank, . . . for the payment of such check...
