Defendant, William Martin, was indicted on a bill which contained two counts, the first for unlawful possession of narcotic drugs on March 11, 1955, and the second for the unlawful sale of narcotic drugs on the same day. The indictment came on for trial before the writer of this opinion on August 8, 1955, defendant having waived a jury trial.
