Plaintiff seeks to revoke the citizenship of defendant on the grounds of both fraud and illegality by virtue of Section 338(a) of the Nationality Act of 1940, 54 Stat. 1158 (now 8 U.S.C.A. § 1451(a)). The Government contends that defendant's naturalization was procured by fraud in that he represented to the Immigration & Naturalization Service that he had never been arrested, whereas in fact he had a criminal record including three convictions...
