This appeal involves the question whether the Appellee who drove his automobile into the back end of Appellant's truck, negligently stopped on the highway, was guilty of contributory negligence as a matter of law, so as to bar his claim for damages. The court below submitted his civil action for personal injuries and destruction of his automobile to the jury which returned a verdict in Appellee's favor for $4,000.00.
