Defendant was charged with violation of section 11500 of the Health and Safety Code in that on April 10, 1954, he unlawfully had marihuana in his possession. He admitted an allegation in the information that on or about April 27, 1951, he had been convicted in the Superior Court of Los Angeles County of violation of said section 11500, a felony.
