This is an action of trespass on the case for negligence to recover damages for personal injuries sustained by the plaintiff as a result of being struck by the defendant's automobile. It was tried in the superior court where a jury returned a verdict for the defendant. Thereafter the trial justice granted the plaintiff's motion for a new trial and the case is here on the defendant's single exception to that decision.
