Plaintiff's decedent was fatally injured when a car that he was driving around a curve in the highway collided with another being driven by defendant in the opposite direction. There were no eyewitnesses to the accident, and at trial the court entered a compulsory nonsuit, holding the circumstantial evidence insufficient to warrant a finding that defendant was the culpable party.
