For a determination of this appeal the essential facts may be stated as follows:

On March 28, 1925, one Percy F. Kearney was the owner of lots 1 and 2 of block 2, Wooddale Heights in Hennepin county. In order to more easily understand the facts stated herein, it may be assumed that these lots run in an easterly and westerly direction, lot 1 lying immediately to the north of lot 2.
