Plaintiff, a sixteen year old boy, was struck and severely injured by defendant's train as he stood upon its crossing at 8th North and 3rd West Streets in Salt Lake City, Utah. Upon issue joined as to defendant's negligence, and plaintiff's contributory negligence, trial was had to the court.
