This is an action in which plaintiff seeks to establish his right to 1 per cent of all oil and gas produced from land in Fresno County. A jury trial resulted in a verdict for plaintiff and thereafter the trial court granted defendants' motion for judgment notwithstanding the verdict. Plaintiff appeals from the judgment entered upon the granting of this motion.
