In this suit plaintiff is seeking to recover damages for the loss of a cow which was struck and killed by the automobile of the defendant on May 13, 1953 at approximately 7 P.M.

The defendant sought to escape liability on the ground that the cow suddenly darted in front of his automobile which allegedly was being driven at a reasonable rate of speed and was struck before he could stop his car or safely avoid the accident, and it was therefore...
