In a county attorney's information filed in the Mills District Court the defendant was charged with the crime of operating a motor vehicle while in an intoxicated condition, third offense, contrary to the provisions of Section 321.281, 1954 Code, I.C.A. He entered a plea of not guilty and was thereafter tried. The jury found him guilty. The trial court later sentenced him to a term of three years in the State Penitentiary at Fort Madison as provided by...
