Defendants appeal from denial of their respective applications for writs of habeas corpus.

Cardinale was convicted of rape and assault and battery upon a Miss B, and assault with intent to rape as well as assault and battery on a Miss P. Monto was also convicted for the latter offense as well as for aiding and abetting Cardinale in committing the rape.
