This cause came on for hearing before the Court on May 2, 1955, upon the defendants' motion to dismiss the plaintiff's complaint, which motion was submitted upon the complaint and exhibits thereto, memorandum briefs, oral argument and certain documentary evidence introduced in the course of said argument. At the conclusion of the argument on the date aforesaid, the Court, after conference, entered an order sustaining the defendants' motion...
