Defendant William Merryman was, by the first count of an information, charged with the crime of wilfully, unlawfully and feloniously having sexual intercourse with a female child under the age of 18 years, not his wife. The crime is alleged to have occurred on or about the 13th day of March, 1954. By the second count of the information, defendant was charged with the crime of incest.
