This appeal comes to this court on questions of law from a judgment for the plaintiff, appellee herein, entered on the verdict of a jury. The action is one seeking damages for the breach of an alleged verbal warranty claimed to have been made by the defendant, as an inducement whereby plaintiff purchased certain residence property from the defendant under a written purchase agreement.
