Defendant Verlon Leroy Pruitt was indicted by the grand jury of Des Moines County for the crime of possession of burglar's tools contrary to section 708.7, Codes 1950, 1954, I.C.A. He pleaded not guilty, was tried by the court and jury, found guilty and sentenced to imprisonment in the penitentiary for an indeterminate period not exceeding 15 years.
