This writ of error brings under review the record in the trial of a tort action wherein Bascom Damron obtained a verdict and judgment for $12,500 for personal injuries received in a collision between an automobile operated by him and a tractor-trailer truck operated by J. A. Brown, Jr.

The parties will be designated as plaintiff and defendant according to the positions they occupied in the lower court.
