The petitioner's dwelling is located in the city of Norwich, within 200 feet of one of the respondent's existing water mains. The respondent refused to extend its water mains to the petitioner's premises except upon condition that the cost of the extension should be paid in the same manner as paving and sewer construction, namely, one third by the property owners on each side of the street and the remaining one third by the city.
