This is an action upon an assignment to recover sums due thereunder. The trial court, holding that no sums remained due and unpaid, rendered summary judgment in favor of the defendant. The plaintiff has taken this appeal. Whether or not sums remain due and unpaid turns upon the meaning which should attach to one word used in the assignment: the word "distributable." The parties are in dispute upon this point and this is the sole issue presented...
