This suit was brought originally in trespass to try title by appellees, D. B. Whatley and Ruth Nell Whatley, against J. G. Whatley. D. B. Whatley and Ruth Nell Whatley are the children by the first marriage and J. G. Whatley is the father of C. B. Whatley, deceased. It is admitted that C. B. Whatley died on January 19, 1954 and was survived by his second wife, Minnie Whatley, and at the time of his death...
