In this case plaintiff, Robert Bennett, brought an action in the circuit court for the county of Wayne to recover for personal injuries sustained as the result of an accident. He was struck by a Checker taxicab, driven by defendant David A. Cowan, in the city of Detroit on December 26, 1949, at about 8:45 p.m. Defendant Reginal Hill, the owner of the taxicab, was joined as a party defendant.
