Freeman Davis, the plaintiff in error, hereinafter referred to as defendant, was charged by information filed in the county court of McCurtain County with the offense of unlawful possession of intoxicating liquor, it being charged that he possessed 33 one-half pints and 5 pints of tax-paid whiskey.
