Convicted on his plea of guilty of violating the Fugitive Felon Act, 18 U.S.C. § 1073, and sentenced on August 29, 1951, to imprisonment for a period of two years, to become effective upon the expiration of two prior sentences, the defendant, on May 7, 1954, filed in the court of his conviction a motion1 to vacate his sentence and dismiss the indictment.
